Photography Session Contract & Model Release

 This agreement is between Jamie Isaacs Photography LLC and contract signer hereinafter referred to as the "Client", and Jamie Isaacs Photography, hereinafter referred to as the "Photographer(s)". 

1. The client expressly understands and agrees that any and all amounts paid pursuant to this contract are non-refundable. 

2. The non-refundable retainer is due upon the signing of this agreement. With the balance of the total amount of the contract due no later than the date of the session.

3. The Photographer has general premises liability coverage for her studio location. The Photographer assumes no liability and does not maintain an insurance policy for any off premises photo shoots and if that is desired, it would be the responsibility of the Client. 

4. The Client assumes any and all risks associated with occupying the premises at the studio location and for any off premises photo shoot as well. This assumption of risks includes, but not is limited to: risks of slip and falls, risks of animal bites or injury therefrom: risks of acts of god or nature: and any and all other risks associated with occupying a premises. 

5. The Client understands that the Photographer frequently uses food items when doing photo shoots. The Client assumes any and all risks associated with food allergies. If the Client does have food allergies, it is the responsibility of the client to inform the Photographer and take all necessary precautions, such as having an alternative to the allergen, an Epi-Pen and avoiding any contact with the allergen.

6. The copyright of photographs remains with the Photographer. The Photographer grants the client permission to make copies of the images under the following conditions. The images taken by the Photographer are for personal use by the Clients. Commercial use of the photographs is not allowed without prior written permission from the Photographer. 

7. The client grants the Photographer and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the Clients for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Clients hereby release the Photographer and its legal representatives, heirs and assigns from all liability and claims in connection with the images. 

8. This only pertains to the "Belly to Birthday" or "Baby to Birthday" packages. When this package has been booked, either full payment must be made up front ($1,700) or you will pay $275 per session. If you fail to perform one of the sessions, the full amount for that session (as priced currently) will be charged. Example, if you do maternity and newborn and fail to do the four month session, the remainder for maternity will be charged as well as the  remainder for the newborn session.

9. A 48-hour notice is required to reschedule a photo shoot. If a 48 hour notice is not given, the client will be granted an opportunity to reschedule. The 2nd time that a photo shoot is cancelled, a rescheduling fee of $25.00 will be due as well as a new retainer fee.

10. ​The parties agree that this contract is the full and final agreement between the parties and this contract is governed by the laws of the Commonwealth of Kentucky.
